Terms of Use

While we are working on the long (and boring) legal document, here are a few things you should know about YouPublish:

1. There is no fee for setting up an account on YouPublish and no fee for posting your publications (e-books, audio, videos, photos, software, seminar packages, and the like).
2. The largest file we accept right now is 100MB. We will try to improve this as we go along.
3. When you sell products on YouPublish, you get 70% of the revenue, and we get 30% (traditional publishers pay 7% to 10% to authors, and the last time we checked, Amazon was paying 35% to its e-book publishers).
4. You will also receive 7.5% of publication sales from user accounts registered using your Personal Referral Link. This will expire in two years. You can't get paid for referring yourself or somebody else in the same household.
5. To keep things efficient, we will only make payments when there is $100 or more owing to your account.
6. Payments are made monthly.
7. The first time we pay you, we will ask you for all the information we need to get the job done. You need to claim money owing to you within one year.
8. You are responsible for paying your own taxes (aren't we all?).
9. Please keep your e-mail address current so we can communicate with you.
10. The stuff you publish can either be free or you may require a payment for downloading and/or viewing in our player. If you set a price for your stuff, it needs to be at least $1.00. (The credit card companies won't process anything smaller for us. Sorry about that.)
11. You will have to pay for the transfer charges incurred in sending you the money. (Wish we had a way to send you the money for free, but alas…)
12. You get to keep all the rights to the stuff you publish through the YouPublish site. You give us the right to store the stuff on our servers, make back up copies, and do all the other stuff we need to do to provide our services. You also give the other users on the site the right to download, print for their own use, and generally use the stuff they download.
13. You can delete the stuff you publish from the site at any time. When you do this, we will maintain copies to serve those who have already purchased or downloaded your stuff, but it will no longer be available for search.
14. The stuff you publish is provided to your readers, viewers, and fans exactly as you gave it to us. We are not responsible for any copy protection or other file conversion or editing.
15. YouPublish does not support the publication of pornography, information in support of terrorism or crime, gratuitous violence, hate speech, or violation of other people's copyrights and/or trademarks. If your publications violate this policy, YouPublish will remove your publications from the site, refuse to pay you any money, remove your account, cooperate with law enforcement to ensure that you get what you deserve, and you agree that all of this is okay.
16. Please don't pretend to be somebody else. There should be enough great stuff in you without having to steal from somebody else.
17. You agree to treat the other people on the site with decency and respect. If you don't, you won't get to play here anymore.
18. YouPublish may post advertisements on any part of the site. We will try to be decent about how we do it and not let things get too cluttered.
19. This policy will change and improve, and probably be made a lot more complicated by a bunch of lawyers. You agree that it is okay for us to change the policy and that the site will be run and our relationship will be carried out according to whatever the latest version of the policy is.
20. The agreement is made in accordance with the laws of the British Virgin Islands, and all the transactions on the site will be deemed to take place there.
21. YouPublish reserves the right to decide what should be allowed on the site, to remove any document, and to determine if a referral is a self referral or a referral in the same household, for which no commissions are available.
22. Because we can't take back a file once we send it to you, all sales on YouPublish are final. If, however, you purchase something that is not at all what the publisher said it was, please let us know and we will try to help you out.
23. We expect that we may, on occasion, be approached regarding possible copyright infringement. Should that happen, we reserve the right to temporarily remove items from circulation pending investigation of copyright infringement.
